The program includes the following engaging posts:
Warning – employer's discretion or legal limitations? A warning is a sanction that an employer can give an employee for a breach of employment obligations in an employment relationship. The Working Environment Act has no rules on warnings – neither regarding the meaning of a previous warning nor procedural rules. Does this mean that the question of warnings is up to the employer's discretion or are there legal limitations on the use of warnings? The law firm Schjødt reviews the rules on written warnings and the significance of any warnings for an upcoming dismissal case. BUHR shares its experiences with the use of warnings and how they recommend that their clients consider using warnings as a means of resolving difficult personnel cases.
Working hours – with a focus on overtime rules and rules for particularly independent positions. As an employer, you are responsible for ensuring that working hours in the company are reasonable. This means that employees' working hours must be within the legal rules.
This involves:
- That the limits for overtime are complied with
- That employees do not work beyond the maximum limits set by law.
- That the categorization of particularly independent and senior personnel is legally assessed correctly so that employees who are exempt from the working hour rules can actually be exempted.
- That on-call arrangements are adequately compensated and that the rules regarding free time and rest time are complied with for employees on on-call arrangements.
The consequences of violating working time regulations can be serious, and several businesses therefore see a need to review their working time arrangements and ensure compliance with the regulations.
The law firm Schjødt guides us through the regulations for working hours and the legal challenges that an employer may face in such a project. BUHR shares its experience with implementing working hours projects in the organization and how the HR function should best proceed to implement such projects in a seamless manner.
