FREE LUNCH SEMINAR – Warnings and working hours

We are pleased to invite you to a breakfast seminar with Schjødt and BUHR on Thursday, March 6. The program includes several engaging presentations on warnings and working hours.

På programmet står følgende engasjerende innlegg:

Advarsel – arbeidsgivers frie vurdering eller rettslige begrensninger? Advarsel er en sanksjon som arbeidsgiver kan gi arbeidstaker for brudd på arbeidspliktene i et arbeidsforhold. Arbeidsmiljøloven har ingen regler om advarsler – verken når det gjelder betydningen av en tidligere advarsel eller prosessuelle regler. Betyr dette at spørsmålet om advarsler er opp til arbeidsgivers frie vurdering eller finnes det rettslige begrensninger for bruk av advarsler? Advokatfirmaet Schjødt gjennomgår reglene om skriftlig advarsel og eventuelle advarslers betydning for en kommende oppsigelsessak. BUHR deler sine erfaringer rundt bruk av advarsler og hvordan de anbefaler at sine kunder legger opp til bruk av advarsler som virkemiddel i vanskelige personalsaker.

Arbeidstid – med fokus på overtidsreglene og reglene for særlig uavhengig stilling. Som arbeidsgiver er man ansvarlig for å sørge for at arbeidstiden i selskapet er forsvarlig. I dette ligger at de ansattes arbeidstid må ligge innenfor lovens regler.

Det innebærer:

  • At grensene for overtid overholdes
  • At de ansatte ikke arbeider utover lovens maksimalgrenser.
  • At kategoriseringen av særlig uavhengig og ledende personell er juridisk riktig vurdert slik at de ansatte som er unntatt fra arbeidstidsreglene faktisk kan unntas.
  • At vaktordninger er tilstrekkelig kompensert og at reglene om fritid og hviletid er overholdt for ansatte på vaktordninger.

 

Konsekvensene av brudd på arbeidstidsreglene kan være alvorlige og flere virksomheter ser derfor behov for å gjennomgå sine arbeidstidsordninger og sikre overholdelse av regelverket.

Advokatfirmaet Schjødt loser oss gjennom regelverket for arbeidstid og hvilke juridiske utfordringer man som arbeidsgiver kan møte på i et slikt prosjekt. BUHR øser av sin erfaring med implementering av arbeidstidsprosjekter i organisasjonen og hvordan HR-funksjonen best bør å frem for å få gjennomført slike prosjekter på en sømløs måte.
